Lawsuit against 62 Indiana hospitals over records is dismissed

SOUTH BEND — A lawsuit against 62 Indiana hospitals over their handling of medical records has been dismissed.

Local attorneys Michael Misch and Bradley Colborn had sued the hospitals — including Memorial Hospital, St. Joseph Health System Mishawaka and St. Joseph Health System Plymouth — in 2016.

They accused the hospitals of failing to disclose electronic medical records in a certain time frame and incorrectly reporting disclosure numbers; they also accused a third party of over-billing for records releases.

Rather than representing private clients, the case’s status as a whistle-blower lawsuit meant the attorneys were representing the state and the U.S., giving state and federal attorneys the right to intervene or request that the case be dismissed.
